Who These Terms Apply To

These terms apply to anyone who:

  • Creates an account with our service
  • Visits our website
  • Purchases a subscription
  • Uses our API (Pro and Team plans)

The Service

312 Elements SEO provides keyword rank tracking, competitor analysis, and SEO insights for photographers and creative professionals. Our service includes:

  • Weekly keyword position tracking
  • Competitor discovery and analysis
  • Domain authority and backlink monitoring
  • Google review tracking
  • AI-powered visibility analysis
  • Email alerts for rank changes

Subscription and Payment

Plans and Pricing

  • We offer Starter, Pro, and Team subscription plans
  • All plans are billed annually
  • Prices are listed on our pricing page and may change
  • Price changes don't affect active subscriptions until renewal

Payment

  • Payment is processed securely through Stripe
  • All prices are in US Dollars
  • Subscriptions auto-renew unless cancelled
  • You'll receive email reminders before renewal

Cancellation and Refunds

  • You can cancel your subscription anytime from your account settings
  • Cancelled subscriptions remain active until the end of the billing period
  • We do not provide prorated refunds for partial periods
  • If you're unhappy within the first 30 days, contact us and we'll work something out

Acceptable Use

What You CAN Do

  • Track keywords for your tenant website
  • Use the data to improve your SEO strategy
  • Export your data for your own use
  • Use our API within your plan's rate limits (Pro and Team only)

Tenant and Account Structure

  • Each tenant is tied to a single website URL that you own and operate
  • Starter and Pro plans track rankings for a single geographic market (city level)
  • Team plans can track rankings across multiple zip codes
  • If you operate multiple websites, each requires its own tenant subscription

API Usage (Pro and Team Plans)

  • API access is limited to 100 requests per hour
  • Bulk data exports are limited to once per day
  • API keys must not be shared or exposed publicly
  • We reserve the right to revoke API access for abuse
  • Rate limits may be adjusted; we'll notify you of changes

What You CANNOT Do

  • Resell our service or data to others
  • Create multiple accounts to bypass plan limits
  • Scrape, reverse engineer, or copy our product
  • Use automated tools to abuse our service
  • Register a tenant for a website you do not own or operate
  • Use the service for any illegal purpose
  • Attempt to gain unauthorized access to our systems

Your Data

What You Own

  • Your account information (name, email, etc.)
  • Your keyword selections and configurations
  • Any content you upload or create

What We Own

  • The service itself, including all code and features
  • Aggregated, anonymized data derived from all users
  • The algorithms and methods we use to analyze SEO data

Data Retention

  • Ranking and competitor data is part of a shared global pool and persists independently of your account
  • Your account-specific data (profile, preferences, keyword selections) is deleted when you cancel
  • You can request a copy of your data before cancellation

Service Availability

We strive to keep our service running smoothly, but:

  • We don't guarantee 100% uptime
  • We may perform maintenance that temporarily affects the service
  • Third-party data providers (Moz, ValueSERP, etc.) may have outages
  • Search engine changes may affect ranking data accuracy
  • We'll notify you of planned maintenance when possible

Limitation of Liability

While we do our best to provide accurate data and reliable service:

  • SEO data is inherently variable and may not be 100% accurate
  • We're not responsible for business decisions you make based on our data
  • If something goes wrong, our maximum liability is the amount you paid us
  • We're not liable for indirect, incidental, or consequential damages

In Plain English: If something goes wrong, the most we'll owe you is what you paid us. We're not responsible for things beyond our control, like Google changing how rankings work.

Termination

We may terminate or suspend your account if you:

  • Violate these terms
  • Fail to pay for your subscription
  • Abuse our service or APIs
  • Engage in fraudulent activity

If we terminate your account for cause, you will not receive a refund.

Changes to Terms

We may update these terms from time to time. When we do:

  • We'll update the "Last Updated" date at the top
  • For significant changes, we'll email you
  • Continued use of the service means you accept the new terms

Legal Jurisdiction

These terms are governed by Illinois and United States law:

  • Illinois state law applies to all agreements
  • Any legal disputes will be handled in Cook County, Illinois courts
  • We prefer to resolve issues directly—please contact us before taking legal action

Severability

If any part of these terms is found to be unenforceable by a court, the rest of the terms still apply.
